Is Website Visitor Identification GDPR-Compliant in 2026?

"Is website visitor identification GDPR-compliant?" is the most common objection EU buyers raise. The short answer: it depends on what data you process, what your legal basis is, and how cleanly you handle opt-out. This guide walks through the practical compliance posture. It is general information, not legal advice — consult your own counsel for your specific situation.

The two types of visitor identification

  1. Company-level: Identifies the company visiting via reverse IP lookup. Does not identify an individual. Generally uncontroversial under GDPR.
  2. Personal-level: Identifies the individual visitor (via first-party cookie matching, form fills, or email-link resolution). GDPR applies in full.

The two things GDPR cares about

  • Legal basis for processing personal data.
  • Transparency to the data subject — they must know, be able to object, and be able to opt out.

Legal basis: legitimate interest for B2B

For B2B contact identification, the most-used legal basis in the EU is legitimate interest (Art. 6(1)(f) GDPR). It requires you to document three things: (1) a legitimate purpose (e.g. proposing a business relationship), (2) necessity (you could not achieve the purpose another way), and (3) a balancing test showing your interest doesn't override the data subject's rights.

Consent is not typically required for B2B prospecting under legitimate interest — but legitimate interest requires paperwork you need to maintain.

ePrivacy and cookies

ePrivacy (the "cookie law") governs what cookies you set. First-party cookies strictly necessary for operation don't typically need consent; tracking cookies do. Happierleads uses first-party cookies; no third-party cookies. How identification works.

Seven things you must have in place

  1. Privacy notice disclosing that you identify business visitors, what data you collect, the legal basis, and retention period.
  2. Documented legitimate interest assessment (LIA) — can be a simple 1-page document.
  3. Working opt-out mechanism — visitors must be able to request removal.
  4. Data subject access request (DSAR) process — be ready to respond within 30 days.
  5. DPA with your visitor identification vendor.
  6. Retention policy — don't keep identified visitor data indefinitely.
  7. Suppression list — once someone opts out, never re-identify them.

Happierleads' GDPR posture

  • First-party cookies only — no third-party tracking.
  • Legitimate interest B2B contact processing.
  • Public opt-out page — single click for any data subject to request removal from the graph.
  • DPA available on request.
  • DSAR process documented.
  • Retention configurable at the customer level.

Common myths to clear up

  • "GDPR bans cold email." It doesn't. Legitimate interest B2B outreach is explicitly allowed when done correctly.
  • "You need consent to identify website visitors." Not strictly — legitimate interest covers B2B identification with proper disclosure.
  • "Cookies are banned." First-party non-tracking cookies are generally fine; tracking cookies need consent.
  • "We're in the UK so GDPR doesn't apply." UK GDPR mirrors EU GDPR for practical purposes.

When you need counsel

If you process sensitive data, operate in a regulated vertical (finance, healthcare), serve a jurisdiction with stricter rules (Germany's interpretation is often stricter than the EU baseline), or handle enterprise procurement reviews, get advice from a qualified data protection lawyer. Website Identification FAQs

Does Happierleads have a Free trial?

We show you who is visiting your website for free for 14 days. If you’d like to keep using it afterward—and export a CSV or send emails via our built-in Email Automation app or your CRM—the cost is $99/month.

What is Happierleads?

Happierleads is the only solution that enables you to identify, qualify, and engage with your anonymous B2B website visitors—all within a single tool. No additional licenses or integrations with other outreach automation tools are necessary.

Who typically uses Happierleads?

Happierleads is used by Sales, Growth, and Marketing teams across various industries. If you are a B2B company, we are the solution for you. Sales teams use the platform to turn anonymous traffic into opportunities and increase productivity. Marketers use the platform to automate lead generation and increase conversions.

How is this different from Clearbit, 6Sense, or DemandBase’s Website Identity Solutions?

Most companies rely on ‘Reverse IP Lookup’ technology to connect IP addresses with company names. At Happierleads, we use a completely different approach—our fully-permissioned, proprietary publisher network—allowing us to identify the exact individuals visiting your website. Discover more about how we identify your site visitors here.

Why is Happierleads ranked number #1 for data quality on G2 and Capterra?

Happierleads offers an advanced feature that automatically filters out bots, ISPs, and other non-qualifying traffic sources to ensure you receive only high-quality leads. Additionally, unlike other tools, Happierleads provides the flexibility for you to manually remove leads as needed.

What about U.S. state privacy laws, like the California CCPA and CPRA?

If you are compliant with these state-level regulations, the use of our product will not change that compliance status. We can now identify exact visitors in 173+ countries including the US, Canada, Australia, and many more. For GDPR-restricted countries (primarily EU member states), we use reverse IP lookup which only provides company information to adhere with GDPR requirements.

How accurate is the visitor identification?

Most reverse-IP tools only identify the company. We go further — using our permissioned publisher network we identify the exact person behind the visit and enrich them with verified work email and LinkedIn data. Match rates depend on traffic geography, but customers typically see person-level identification on 30–55% of B2B sessions and company-level on 80%+.

How long does setup take?

About 5 minutes. Sign up, paste a single tracking snippet into your site (or install our GTM template / WordPress plugin), and identified visitors start appearing in your dashboard within a few hours. No engineering project required.

What if my website doesn't get much traffic?

You don't need huge traffic to win — most of our customers have under 10,000 monthly visitors. Even on lower-traffic B2B sites a handful of identified buyers per week often pays for the tool many times over. You can also pair it with our 175M-contact database and outreach engine to build pipeline beyond just your site visitors.

Does it integrate with my CRM and outreach tools?

Yes. Push identified leads directly into HubSpot, Salesforce, Pipedrive, Zoho, GoHighLevel, Slack, or anything that supports Zapier and webhooks. CSV export is available on every plan, and our built-in email and LinkedIn outreach engine lets you act on identified visitors without leaving Happierleads.
